The U.S. Commodity Futures Trading Commission (CFTC) has invoked its emergency authority to mandate the continued operation of prediction market Kalshi, marking a critical escalation in a jurisdictional clash over whether state-level gambling laws apply to federally regulated event contracts. Federal Supremacy vs. State Gambling Enforcement

The CFTC's order issued on Tuesday argues that New York’s enforcement actions and request for a temporary restraining order constitute a "market emergency." The Commission directed Kalshi to continue operating in line with its standard practices and the Core Principles of the Commodity Exchange Act.

    At the heart of this legal battle lies the question of whether federal law preempts state gambling statutes. In a lawsuit filed on July 31, New York accused Kalshi of operating an illegal, unlicensed gambling business, seeking compensatory damages of at least $36 billion pending an accounting.
  • The state is seeking restitution, disgorgement, and penalties, including a penalty equal to three times Kalshi’s alleged gains and $100,000 for each unauthorized sports wagering offer or attempt in New York.
  • The CFTC contends that the Commodity Exchange Act requires it to provide a uniform national derivatives market and that major disruptions threaten orderly trading and price discovery.
  • In a separate federal case in New York, a judge previously denied Kalshi’s request for a preliminary injunction, finding that New York gambling laws were not preempted by the Commodity Exchange Act at that stage.
  • Regulatory Turbulence Over Event Contracts

    While the latest CFTC order directs Kalshi to maintain operations, it does not conclude New York’s lawsuit or resolve the underlying jurisdictional dispute. It is not a judicial ruling on the preemption of state gambling enforcement by federal law. Nevertheless, the Commission has made it clear that it is actively suing New York and eight other states to defend its congressionally granted jurisdiction.
    This intervention underscores the critical importance of federal preemption in the regulation of prediction markets and derivatives at large.
