Commodity Futures Trading Commission (CFTC) Chair Michael Selig has signaled that the agency will proceed with crypto regulations even in the absence of the Digital Asset Market Clarity (CLARITY) Act passing Congress. Selig stated that the CFTC will give CLARITY 'breathing room' for a vote but will move forward with new rules if lawmakers cannot reach a bipartisan compromise. The chair directed staff to allow registered and non-registered entities to offer leveraged or margined crypto asset trading and explore developer protections. 'If Democrats cannot support a bipartisan work product and ultimately send a fair version of the bill to the President’s desk, rest assured, I will direct CFTC staff to move swiftly to propose these new rules for the industry,' Selig said. The market structure bill is paused until the Senate returns in September, with Majority Leader John Thune expected to hold a cloture vote. CLARITY would need 60 votes to pass the Senate and return to the House, where it could go to President Trump’s desk. Democrats have pushed for stronger ethics provisions in the bill, particularly addressing the Trump family’s $1.4 billion crypto investments in 2025. Selig’s agenda aligns with the U.S. Securities and Exchange Commission (SEC), which released proposed rules for digital asset regulation, including safe harbor policies for tokens and exemptions for issuers. The CFTC’s Innovation Advisory Committee also discussed artificial intelligence and prediction markets, with Selig asserting the agency’s 'exclusive jurisdiction' over prediction markets due to event contracts being considered 'swaps.' > The future of crypto regulation is hinging on Congress’s political dynamics and the CFTC and SEC’s efforts to assert their authorities. While CLARITY’s passage hinges on political hurdles, the commissions may still push forward with their own regulatory proposals, signaling a critical juncture for the crypto markets.
