Nigeria's Crypto Tax Framework: New Obligations for Platforms

Nigeria’s Revenue Service has rolled out a comprehensive tax collection framework for crypto asset platforms, tightening regulation in the digital economy.

Nigeria's Digital Tax Shield

The Nigeria Revenue Service (NRS) outlined in its "Guidelines on Taxation of Virtual Assets" how earnings from crypto disposals, staking, airdrops and DeFi activities will be taxed, mandating that certain amounts be paid in the originating token.

New Tax Obligations and Rates

  • 1% withholding on proceeds from crypto disposals and security tokens.
  • 10% withholding on staking, mining, airdrops and DeFi activities.
  • 1.5% stamp duty on token‑to‑fiat and fiat‑to‑token transfers.
  • 30% corporate income tax rate (excluding small companies).
  • Compliance Roadmap for Platforms

Exchanges and P2P marketplaces must withhold, report, and remit taxes at source. Income tax and stamp duty are to be remitted in the originating token, while VAT must be paid in the currency used for the transaction.

    Implications for Markets and Investors

  • Stablecoin sales exempt from the 1% withholding tax.
  • Withheld amounts are treated as advance payments against final income tax liability.
  • The 10% capital gains tax introduced in the 2023 Finance Act has been replaced by a valuation‑based regime under the 2025 framework.
  • Platforms must report customer details and TIN (Tax Identification Number) to regulators.
  • Taxing digital assets positions Nigeria to modernize its fiscal architecture, yet the compliance burden may compress liquidity on local exchanges and P2P venues in the short term. Over the longer horizon, increased transparency and higher tax revenues could underpin a more sustainable and investor‑friendly crypto ecosystem.
