Apple has filed what it calls ‘shocking evidence’ in its lawsuit against OpenAI, bolstering its allegations that former employee Chang Liu stole trade secrets for OpenAI’s benefit. New details emerged after Liu’s former Apple work laptop was handed over for investigation. Apple alleges Liu used a confidential Apple circuit schematic at OpenAI and a tool sharing a name with an internal Apple engineering application. The company claims OpenAI was ‘well-aware’ of Liu’s access to Apple data and that he enlisted OpenAI colleague Yu-Ting Peng to help destroy evidence in June when Apple began investigating him. Apple’s filing references text messages from Liu, punctuated with ‘crying laughing’ emojis, showing his awareness of continued access to Apple files. OpenAI has defended Liu, saying he only accessed Apple files after leaving to help former colleagues. However, Apple claims Liu had continued access due to an ‘exploited rare, previously unknown authentication bug.’ Apple is seeking a preliminary injunction blocking OpenAI from working on Apple-based hardware and expedited discovery, alleging more former employees may be involved. Over 400 former Apple employees now work at OpenAI, according to Apple’s initial filing.
The tech espionage war has entered a new phase. Apple’s lawsuit against OpenAI signals a broader struggle over protecting proprietary technology in the AI era. While short-term volatility in Apple and OpenAI stock prices may follow, the long-term impact could reshape industry standards for data security and intellectual property protection.
