Bitpanda Fined in Austria’s First Published MiCA Penalty
Avusturya Finans Piyasası Otoritesi (FMA), Avrupa Birliği'nin Kripto Varlıklar Piyasası (MiCA) düzenlemeleri kapsamında, kripto platformu **Bitpanda**

Austria’s Financial Market Authority (FMA) has issued its first published final penalty under the European Union’s Markets in Crypto-Assets (MiCA) regulation, fining crypto platform Bitpanda for breaches in documentation and marketing protocols.
Austria Enforces MiCA with First Publicized Penalty
The FMA imposed a fine of 70,000 euros ($82,000) on Bitpanda, marking the first finalized penalty under MiCA in the jurisdiction. The regulator concluded that the platform failed to adhere to strict timelines and disclosure requirements mandated by the comprehensive crypto framework.
Specific Regulatory Breaches Identified
The investigation revealed lapses in Bitpanda's compliance workflow, specifically regarding the issuance of white papers and promotional materials:
Formal Rectification Over Security Concerns
Bitpanda responded to the penalty by clarifying that the infractions were limited to the timing and formalities surrounding the publication of documentation. The company emphasized that customer funds and platform security remained uncompromised and that no financial harm was incurred by users. The proceedings were resolved expeditedly with the company's consent.
From a DeFi analytical perspective, this fine serves as a critical stress test for operational compliance in the Web3 space. While the 70,000 euro fine is financially negligible for a major exchange like Bitpanda, the precedent is significant. It signals that European regulators are actively monitoring the meta-data of crypto operations—white papers and marketing—just as rigorously as on-chain treasury management. For smart contract platforms and liquidity pools, this reinforces the reality that off-chain regulatory compliance is now as vital as on-chain security.
